This website, goldzenn.com (the “Site”), is owned and operated by GOLDZENN (GoldZenn LLC), a Florida limited liability company. Throughout these Terms of Service (“Terms”), the words “we,” “us,” and “our” refer to GOLDZENN. The terms “you” and “your” refer to you, the user or customer.

GOLDZENN is a luxury jewelry brand based in Miami, Florida, specializing in gold and silver jewelry including Cuban link chains, tennis chains, bracelets, earrings, pendants, and rings. We offer both ready-to-ship and made-to-order jewelry crafted in 10K, 14K, 18K, 22K, and 24K gold, as well as 925 Sterling Silver and 950 Silver, featuring laboratory-grown diamonds and Moissanite.

By accessing or using our Site, placing an order, or engaging with any of our services, you agree to be bound by these Terms, our Privacy Policy, our Return & Refund Policy, and our Shipping Policy, all of which are incorporated herein by reference. If you do not agree to these Terms, please do not use this Site.

3. Eligibility

You must be at least eighteen (18) years of age to use this Site or place an order. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are under 18, you may not use this Site or purchase any products.

By agreeing to these Terms, you confirm that you are at least 18 years old. If you allow a minor in your household to use this Site, you are responsible for their activity and any purchases made under your account.

You may not use our products or services for any illegal or unauthorized purpose, nor may you, in the use of the Site, violate any laws in your jurisdiction (including but not limited to copyright laws).

A breach or violation of any of these Terms may result in termination of your access to our services.

5.1 Product Availability

All products displayed on the Site are subject to availability. We reserve the right to discontinue any product at any time without notice. We do not guarantee that all products shown on the Site will be in stock at the time of your order.

5.2 Product Descriptions and Accuracy

We make every effort to display our products as accurately as possible, including descriptions of materials, dimensions, weight, and gemstone specifications. However, we do not warrant that product descriptions, pricing, or other content on the Site are error-free, complete, or current.

If a product you receive does not match its description, please contact us immediately. We will offer you a replacement, exchange, or full refund at your choice, in accordance with our Return & Refund Policy.

5.3 Product Images and Color Accuracy

We strive to display the color and appearance of our jewelry as accurately as possible. However, the actual color and appearance of products may vary from what is displayed on your screen due to differences in monitor settings, screen resolution, photography lighting, and individual display calibrations. Gold tones (yellow, white, rose), silver finishes, and gemstone colors may appear slightly different in person than on screen. These variations are inherent to viewing jewelry products online and do not constitute a defect or misrepresentation.

Product photographs may also show items at enlarged or reduced scale for detail purposes. Please refer to the product dimensions and weight listed in each product description for accurate sizing information.

6. Precious Metals and Materials

6.1 Metal Purity and Karat Disclosures

GOLDZENN offers jewelry in the following precious metal purities:

Gold: 10K (41.7% gold), 14K (58.3% gold), 18K (75% gold), 22K (91.7% gold), and 24K (99.9% gold)
925 Sterling Silver: 92.5% pure silver, alloyed for durability
950 Silver: 95% pure silver, a higher-purity silver alloy

All karat and purity designations listed on our product pages are accurate to the best of our knowledge and in compliance with the Federal Trade Commission (“FTC”) Jewelry Guides (16 CFR Part 23). Gold jewelry is stamped or hallmarked with the appropriate karat designation. Silver jewelry is stamped with the applicable purity mark (925 or 950).

The remaining alloy content in gold and silver jewelry consists of other metals used to increase durability, strength, and achieve the desired color (e.g., copper, zinc, nickel, palladium). These alloys are standard in the jewelry industry.

6.2 Allergy and Sensitivity Disclaimer

Some gold alloys (particularly 10K and 14K) may contain trace amounts of nickel or other metals. If you have known metal allergies or sensitivities, please contact us at contact@goldzenn.com or (321) 521-4651 before purchasing to discuss material composition. GOLDZENN does not warrant that any product will be hypoallergenic or suitable for individuals with metal sensitivities.

6.3 Gemstone Disclosures

GOLDZENN uses a variety of gemstones in our jewelry, including but not limited to laboratory-grown diamonds, natural diamonds, cubic zirconia (CZ), moissanite, emeralds, sapphires, and other precious and semi-precious stones. The specific gemstone type, origin (natural or laboratory-created), and any relevant quality specifications are disclosed on each individual product page.

In accordance with FTC guidelines, all laboratory-created gemstones are clearly identified as such in our product descriptions. We do not sell gemstones that have undergone undisclosed treatments.

7. Orders, Pricing, and Payment

7.1 Order Acceptance

When you place an order on the Site, you are requesting to purchase a product. Your order becomes final when we ship the item or, for made-to-order items, when production begins. We may need to decline an order if the item is out of stock, if there is a pricing error, or if we detect potential fraud — in any of these cases, you will receive a full refund.

An order confirmation email confirms that we have received your order. In rare cases involving inventory errors, pricing discrepancies, or suspected fraud, we may need to cancel an order after confirmation. If this happens, you will be notified promptly and receive a full refund.

7.2 Pricing

All prices on the Site are listed in United States Dollars (USD) unless otherwise stated. GOLDZENN’s prices are influenced by the current market price of precious metals and gemstones, and prices are subject to change without notice. For made-to-order items, the price at the time of order placement and full payment is the price you will be charged. Layaway purchases are subject to price adjustments based on market fluctuations as described in our Return & Refund Policy.

We reserve the right to correct pricing errors. If we discover a pricing error after your order is placed, we will contact you before shipping to offer the correct price or a full refund at your choice.

Prices do not include applicable sales tax, duties, or customs fees, which are the responsibility of the buyer. For international orders, import duties, taxes, and brokerage fees may be charged upon delivery and are the sole responsibility of the customer.

7.3 Payment Methods

We accept major credit cards (Visa, Mastercard, American Express, Discover), debit cards, and additional payment methods as displayed at checkout, including Apple Pay, Google Pay, and Shop Pay. All payments are processed securely through Shopify Payments. We do not store your full credit card information on our servers.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address, credit card numbers, and expiration dates, so that we can complete your transactions and contact you as needed.

7.4 Buy Now, Pay Later (BNPL) Services

We offer buy now, pay later options through Affirm, Shop Pay Installments, Afterpay, and PayPal Pay Later. These services are provided by independent third-party lenders, not by GOLDZENN. By using a BNPL service, you enter into a separate credit agreement with that provider, subject to their own terms and conditions, privacy policies, and credit evaluation processes.

GOLDZENN is not a party to your BNPL agreement and is not responsible for the terms, interest, fees, or collection practices of any BNPL provider. Returns of items purchased via BNPL are subject to GOLDZENN’s Return & Refund Policy. It is your responsibility to contact your BNPL provider regarding any adjustment to your payment plan following a return or refund.

Items designated as FINAL SALE remain final sale regardless of payment method — you remain obligated to complete all BNPL installments even if the item is not eligible for return. Third-party BNPL providers may also conduct their own age and identity verification as part of their credit approval process.

8. Made-to-Order and Custom Jewelry

8.1 Production Times

GOLDZENN offers both ready-to-ship and made-to-order products:

Ready-to-Ship Items: These items are in stock and typically ship within 3–5 business days after order confirmation.
Made-to-Order Items: These items are crafted after your order is placed. Production time is approximately 4–6 weeks, after which the item will ship. Production times are estimates and may vary based on complexity, materials, and order volume. We will notify you of any significant delays. Production timelines may also be extended due to circumstances beyond our reasonable control, including those described in Section 26 (Force Majeure).

Each product page indicates whether the item is ready-to-ship or made-to-order. Made-to-order items that use a standard catalog design (e.g., a Cuban link chain in a standard width and length) are eligible for returns under the applicable return rules in our Return & Refund Policy once delivered and inspected.

8.2 Custom Orders

Custom orders are pieces made to your specific requirements (e.g., custom length, custom design, special engraving, non-standard specifications). Because custom orders are produced specifically for you:

Custom orders are FINAL SALE — non-refundable and non-returnable once production begins.
Once production on a custom order has begun, it cannot be cancelled or modified.
You will receive a confirmation of the custom order specifications before production begins. It is your responsibility to verify all details (length, width, karat, gemstones, engraving text) before approving production.
We strongly recommend contacting us at (321) 521-4651 before placing a custom order to discuss specifications and ensure the piece meets your expectations.

8.3 Order Cancellation

Orders may be cancelled within 12 hours of placement, subject to a 5% cancellation fee to cover payment processing costs. Orders cannot be cancelled once a tracking number has been issued or production has begun on made-to-order or custom items. 9. Shipping

We ship to addresses within the United States and select international destinations including Canada, the United Kingdom, Australia, Spain, and other countries. Shipping rates and estimated delivery times are detailed in our Shipping Policy.

Key shipping terms:

Domestic shipping (United States): Rates range from $25 to $119 depending on item value and shipping method.
All shipments are sent via UPS, FedEx, USPS, DHL, or other major carriers with tracking and full insurance.
International orders may be subject to customs duties, taxes, and brokerage fees, which are the responsibility of the buyer.
All shipments are fully insured during transit. In the event of loss, theft, or damage during shipping, please contact us immediately. GOLDZENN will file the insurance claim with the carrier and, upon insurer approval, will either re-ship the item or issue a full refund at GOLDZENN’s discretion.

10. Returns and Refunds

We want you to be completely satisfied with your GOLDZENN purchase. Our return policy provides a 14-day return window from the date of carrier-confirmed delivery. Below is a summary of the key return tiers. Specific product categories have different rules — always refer to our complete Return & Refund Policy for the full terms that govern your purchase.

10.1 Standard Return Tiers (Ready-to-Ship Items)

10.3 General Return Conditions

Items must be returned in their original, unworn condition with all original packaging, certificates, tags, and accessories.
Returns must be initiated within 14 days of carrier-confirmed delivery.
A Return Authorization (RA) number is required before shipping any return.
GOLDZENN provides a prepaid return shipping label for all eligible returns.
GOLDZENN reserves the right to limit returns for customers who have exceeded 3 returns within a 12-month period.

11. Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address.

In the event that we make a change to or cancel an order, we will attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made.

You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account and payment information so that we can complete your transactions and contact you as needed.

12. Product Care, Warranty, and Defect Reporting

12.1 Product Care

Jewelry is a delicate product that requires proper care to maintain its appearance and integrity. By purchasing from GOLDZENN, you acknowledge that:

Normal wear and tear, including minor scratches, tarnishing (especially on silver), and loosening of clasps over time, is not considered a defect.
Damage resulting from misuse, improper care, exposure to chemicals (chlorine, perfume, cleaning agents), or unauthorized repair or modification by a third party is not covered under our warranty or return policy.
It is your responsibility to follow the care instructions provided with your purchase.

12.2 Warranty Coverage

We stand behind the quality of every GOLDZENN piece. All products are backed by a 1-year limited warranty covering defects in materials and workmanship under normal use, including:

Clasp or closure failures
Stone setting defects (loose or fallen stones not caused by impact)
Manufacturing defects in chain links or metalwork

In addition, all handmade Cuban link chains carry a lifetime warranty against defects in materials and workmanship, covering link separation, breakage under normal wear, and clasp or closure failures for the life of the product.

What is NOT covered by warranty: normal wear and tear, scratches, tarnishing, damage from misuse or accidents, items altered or repaired by a third party, loss or theft, and items purchased from unauthorized resellers.

Warranty service covers the cost of labor and minor repairs. If a warranty repair requires significant additional material (such as gold or silver), GOLDZENN will provide a cost estimate for your approval before proceeding. Shipping costs both ways are the customer’s responsibility for warranty claims.

12.3 Reporting Damaged, Defective, or Incorrect Items

If your item arrives damaged from shipping or has a visible defect, please report the issue within 48 hours of carrier-confirmed delivery. This short reporting window is necessary for shipping damage claims, which require timely documentation for the carrier’s insurance process. Include your order number, clear photographs, and a written description of the issue.

Manufacturing defects (such as a faulty clasp or loose stone setting) that are not immediately visible may be reported within the 14-day return window and will be handled under our standard return process. Defects discovered after 14 days but within the warranty period are covered under the warranty described in Section 12.2 above.

For verified defects, GOLDZENN offers a replacement, exchange, or full refund — regardless of the item’s price tier — at no cost to you. A prepaid return label will be provided.

13. Intellectual Property

All content on this Site, including but not limited to text, graphics, logos, images, product photographs, product designs, videos, and software, is the property of GOLDZENN or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

The GOLDZENN name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of GoldZenn LLC. You may not use these marks without our prior written permission.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site without our express written consent, except as permitted by applicable law.

14. Optional Third-Party Tools and Links

We may provide you with access to third-party tools (such as payment processors, shipping calculators, or product reviews) over which we have no control. You acknowledge and agree that we provide access to such tools on an “as is” and “as available” basis, without any warranties, representations, or conditions of any kind.

Our Site may contain links to third-party websites that are not owned or controlled by GOLDZENN. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that GOLDZENN shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any such third-party websites.

15. User Comments and Submissions

If you voluntarily submit content at our request (for example, product reviews, testimonials, or contest entries), or if you send us creative ideas, suggestions, or proposals (collectively, “Submissions”), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Submissions that you forward to us. We are and shall be under no obligation to (a) maintain any Submissions in confidence, (b) pay compensation for any Submissions, or (c) respond to any Submissions.

This section applies to voluntarily submitted content such as reviews, testimonials, and creative suggestions. It does not apply to photographs or materials submitted as part of a warranty claim, return request, or customer service communication, which are used solely for the purpose of resolving your inquiry.

You agree that your Submissions will not violate any right of any third party, including copyright, trademark, privacy, or other personal or proprietary rights, and will not contain defamatory, unlawful, abusive, or obscene material.

16. Personal Information and Privacy

Your submission of personal information through the Site is governed by our Privacy Policy, which details how we collect, use, store, and protect your personal data in compliance with applicable privacy laws including the California Consumer Privacy Act (CCPA), the General Data Protection Regulation (GDPR), and other applicable state and international privacy laws.

In addition to other prohibitions set forth in these Terms, you are prohibited from using the Site or its content:

To infringe upon or violate our intellectual property rights or the intellectual property rights of others;

To submit false or misleading information;
To upload or transmit viruses or any other type of malicious code;

We reserve the right to terminate your use of the Site for violating any of the prohibited uses.

Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information on the Site at any time without prior notice.

If we discover a pricing error after your order is placed but before shipment, we will contact you to offer the correct price or a full refund at your choice. We will not cancel a confirmed order without first notifying you and providing an opportunity to proceed at the corrected price or receive a refund. Orders that have already been shipped and delivered at a listed price are considered final.

19. Disclaimer of Warranties

We stand behind the quality of every GOLDZENN piece and are committed to your satisfaction. If your jewelry has a manufacturing defect, please contact us and we will work to make it right under our warranty program (see Section 12). The following legal disclaimers are standard for e-commerce and required by law, but they do not change our commitment to quality and customer service.

THE SITE AND ALL PRODUCTS AND SERVICES DELIVERED TO YOU THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF IMPLIED WARRANTIES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

20. Limitation of Liability

IN NO EVENT SHALL GOLDZENN, GOLDZENN LLC, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCTS PROCURED USING THE SITE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SITE OR ANY PRODUCT, INCLUDING BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, EVEN IF ADVISED OF THEIR POSSIBILITY.

IN NO EVENT SHALL GOLDZENN’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS, YOUR USE OF THE SITE, OR ANY PRODUCT PURCHASED THROUGH THE SITE, EXCEED THE AMOUNT YOU ACTUALLY PAID TO GOLDZENN FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

21. Indemnification

You agree not to use our Site in ways that could cause harm to GOLDZENN or to others. If your misuse of the Site, breach of these Terms, or violation of any law or third-party rights results in legal claims or demands against GOLDZENN, GoldZenn LLC, or our officers, directors, employees, agents, or service providers (including reasonable attorneys’ fees), you agree to indemnify and hold us harmless from such claims. This provision is intended as a mutual protection and applies only to claims arising from your conduct.

22. Severability

If any provision of these Terms is determined to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions of these Terms will continue in full force and effect.

23. Termination

These Terms are effective unless and until terminated by either you or us. You may terminate these Terms at any time by discontinuing use of the Site.

We may terminate or restrict your access to the Site if we reasonably believe you have violated these Terms. If we terminate your access:

Any pending orders will be fulfilled or refunded.
Any existing store credit balance will be honored.
We will make reasonable efforts to notify you of the reason for termination and provide an opportunity to resolve the issue where appropriate.

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of these Terms for all purposes, including Sections 19, 20, 21, and 26.

24. Entire Agreement

These Terms, together with our Privacy Policy, Return & Refund Policy, and Shipping Policy, constitute the entire agreement between you and GOLDZENN and govern your use of the Site, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us.

Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party.

25. Modifications to Terms of Service

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our Site. It is your responsibility to check our Site periodically for changes. Your continued use of or access to our Site following the posting of any changes to these Terms constitutes acceptance of those changes.

Before initiating formal legal proceedings, you agree to contact GOLDZENN at contact@goldzenn.com to attempt to resolve any dispute informally. We will make good-faith efforts to address your concerns within 30 days.

If informal resolution is unsuccessful, any disputes arising out of or relating to these Terms or the use of the Site shall be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you hereby consent to the personal jurisdiction and venue of such courts.

27. International Customers

If you are a consumer in the European Union, United Kingdom, Australia, Canada, or Spain, nothing in these Terms affects your statutory consumer rights under the laws of your country of residence that cannot be waived or limited by contract. These Terms are intended to apply to the fullest extent permitted by the laws of your jurisdiction.

28. Force Majeure

GOLDZENN shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, war, terrorism, labor disputes, government actions, supply chain disruptions, or interruptions in precious metal or gemstone supply.
